THE AMENDED LICENSING ACT.
The.following are the principal clauses in the Licensing Act Amendment Act of last session:—
A bill intituled An . Aot to Amend the, Licensing Act, 1873, Amendment Act, 1874. Be it enacted by the General Assembly in Parliament 'assembled, and by the authority of the same, as follows :—l. The short title of, this act shall be the Licensing Amendment Act, 1875. 2. The proviso to the 13th section of the Licensing Act, Amendment Act,'lß74,is hereby repealed, arid in lieu thereof it is provided that no Court shall grant a license to any applicant at any such meeting, if such applicant, or any person in his behalf or in his interest, has at any previous meeting (whether within the same district or in any other district) been refused a license on the ground that such applicant, or such person as aforesaid, was an unsuitable person to hold a license under the said Act 3. Nothwithstanding anything contained in the Licensing Act, 1873, Amendment Act, 1874, no wholesale license or brewer's license shall be issued to any person by any Provincial Treasurer, or any other person,'under the 10th section of the said act, to take effect within the respective districts defined under the said Act, and mentioned in the schedule hereto, or in any other district which may hereafter be defined'in lien of, or in substitution for. the districts mentioned in the said si-h'-dule. unless the issue of such license sbal first have been approved of by the Licensing Court having jurisdiction at the place or places where it is intended such license shall take effect. The production of a certificate in writing, under the hand of the chairman of such Licensing Court, as aforesaid, to the effect that such Court approves of the issue of the license therein mentioned to the person to be named therein, shall be sufficient evidence that the Court approves of the issue of such license. 4. Any holder of a license refusing, either personally or through any one acting on his behalf, except for some valid reason, to supply lodging, meals, or accommodation to travellers, or supplying intoxicating liquors to a person already in a state of intoxication, shall, for each offence, be liable, on conviction, to forfeit and pay any sum not exceeding £10.
