(Before; W. Fbaseb Esq., E.MO. ASSAULT. James Burrell was summoned for assaulting Henry Kemp, by striking him several times on the head with his clen- - -*ched hand. - - , ,? : ";. , Mr Dodd for plaintiff; Mr Macdonald for defendant. Henry Kemp said he went about a quarter to seven on Tuesday morning, to see a water closet which was shifted from hia premises during" the night, which he saw laying down in defendant's premises; and while he was looking at it, defendant .rushed out and knocked him down; he sent his wife for a policeman ; immediately. Defendant told him to #o,^, off after he had struck him. 'DiP^W i fendant had threatened, him before < this, and asked him to fight. About four months ago he had moved the closet from 1 one part of the allotment to another while defendant was at Ohiiiemuri. Mrs Mooney said she saw, Kemp and Burrell fightiog about the closet in question. Kemp was trying to take, it away, and defendant preventing him. ' On hearing this His Worship imme* - diately ruled that he had no.jurisdiction in the matter, as the question involved would now be one of title, which was-out* side bis province to decide. ;. .. The Court then rose..'
