Frederick Bennett, on reinarid, was charged witli feloniously stealing from Parawai Gardens, on or about 25 th May, J875, a quantity of trees- and shrubs of the "value of thp property pf one W. H. Cassin. ' ' |
Mr Brassey for the prosecution. He might say that Mr Cassin was now convinced that there was no -felonious intention on the part of Mr Bennett; against whom a warrant had been issued under a misapprehension. Mr Cassin being satisfied of this, would like to withdraw the charge against Mr Bennett. ; Mr Macdonald said the Bench woulcj. see' from the statement' of his learned friend that the view of the case he had given yesterday was borne out; and 1 as Mr. Cassia had done all he could to re-
move the .wrong impression which might have been created on the public mind by this-unfounded charge, they were willing to accept the explanation. ,- Mr Bullen said there was no objection; on the part of the Crown to the case being dismissed. The Bench said under tho circumstances the case was dismissed. ! The Court adjourned.
