A ...-,.: By defendant: I did not know at the time, whose horse it was, but hare heard since that it belonged to Mr Smith. E. S. Brown, poundkfeper, deposed—* That he recollected receiving a hors* on last Monday morning. The horse was released by Mr Smith. By defendant —I am sure you released the Jiorse. I don't know whether it was you or your brother. You released it for E.N. Smith. Defendant said it was no horse of his that was in pound; he knew nothing about it. He did not release the horse. His horse was never at large. The poundkeeper was recalled by tt Court, and deposed—That he entered:_ his book when the horse was received and when discharged. 'The horse was entered in his book to Mr Smith. He took defendant for the man; There were two brothers so much alike, that he generally passed both of them as one; He could not positively say the defendant was the man. Witness entered the initials when he did not know the party. Mr Bullen asked that the case be remanded that defendant's brother might be subpounied.
