WARDEN'S COURT.
THIS DAY. (Before W. Fbasek, Esq., Warden.) If CLEABT AND BOWL AND V. WATTS AND . MILLS. James MeLeary and Edward Rowland (both of Grahamstown) complain that the defendants, David Watts and George L. Mills, are the registered owners of two full shares or interests in a claim known and registered as the Dolly Varden, situated in the Waitahi Creek in the Hauraki Goldmining District, and that the defendants have neglected to bona fide and continuously, work their said shares or interests in the said claim, in accordance with the Regulations, made for the Hauraki Goldmining District;, to wit, by one man for every 15,000 square feet of land comprised in the said claim ; wherefore complainants claim that the defendants be adjudged to have forfeited their shares in the claim, by reason ot the premises, and thatrthe complainants have made and giren to them an order by the Warden, in writing, authorising them to take possession of the said shares. There was no appearance of defendants. James McLeary deposed—That he had a miner's right. He, with Rowland, wished to get possession of the Dolly Varden, situated at the head of the Waiotahi. It had not beea worked by defendants for the last three weeks. Had seen one of the men, David Watts, and got a transfer of his interest from him. (That was the transfer produced.) Watts had gone to Wellington. Rowland (witness's mate) had a miner's right. John Robinson, Receiver of Goldfielda Revenue, deposed that Rowland was the holder of a miner's right (No. 572), and knew him to be mates with McLeary. John Brooks Mason deposed—That he knew the Dolly Varden claim. Knew the defendants had neglected to worjc the ground. John McKenzy, Clerk of the Warden's Court and Acting-Registrar for the Hauraki Goldmining: District, produced the register of the Dolly Varden claim ; shareholders—Edward Lauranee, David Watts, and' George L. Mills. The Warden made an order that the shares of David Watts and George L. Mills be forfeited, and that defendants may take possession thereof.
