- In the Auckland Supreme Court yesterday the hearing in the libel case of the Queen versus Eeed and Brett was brought to a close at four o'clock, when the jury retired to consider their verdict. TJp to the time of the jury obtaining permission to retire, they had not been able to arrive at a unanimous conclusion, certain juror 3 holding an opinion that the charge should not have been brought under the criminal law. This morr:ng the discordant elements remained in the same position: that is to say, no advance had been made towards a unanimity of opinion, in consequence whereof the jury was discharged. This circumstance is undoubtedly un*fortunate and will be regretted by those who expected to hear a final decision -given to-day. Further litigation will yensue, Captain Fraser having expressed himself yesterday to the effect that if the jury were dismissed—which is now the case— he would " bring the case on again with a common jury..
