THAMES BOROUGH COUNCIL.
TN accordance -with Section 189 of tho Mumcipal Corporations Act, 1867, the following copy of the Draft Bye-law proposed to be made by tho Council of the Borough of Thames ia hereby published for general information, W. Davies, Mayor. P. C. Dbak, Town Clerk. Grahamstown, Thames, July 30,1874.
BYE-LAW, No. 3. Bye-law of the Council of the Borough of Thames made in accordance with the
Municipal Corporations Act 1867. In pursuance of the powers rested in them under tho Municipal Corporations Act, 1867, The Council of the Borough of Thames ordain as follows that is to s»y: —
Any person guilty of any of tho following offences omissions or neglects within the Borough of Thames shall on being convicted of any such offence neglect or omission be liable to pay any penalty not exceeding (£5) Five Pounds.
1. Throwing or sweeping ar>y glass filth dirt rubbish orange peel or other matter of a similar nature upon or into any street channel footway court alley or public place whatsoever.
2. Leading or riding any horse or other animal or drawing wheeling or driving any cart carriage sledge truck barrow or other thing upon or along any footpath without permiesion from the Borough Council bo to do.
3. Burning any shavinga straw or other materials or matter upon any footway channel surface drain or carriage road without permission from the Borough Council so to do.
4. Throwing or placing upon _ any street or footpath any lighted or burning matches paper wood or other burning substance whatsoever.
4A. Drawing or trailing any sledge timber or other material upon any footway or carriage road to the injury cf such fcotway or carriage road. 5. Allowing night soil or other offensive matter to be spilt or otherwise cast on to or upon any road street footway public place or thoroughfare. 6. Leaving any inflammable material! or matter in any public street or place or on any open ipace near any building without permission from^the Borough Council ao to do. 7. Placing any placard or other document writing or painting on or otherwise defacing any home or building or any wall fence lamp-post or gate without tho consent of the occupier or owner thereof. 8. Allowing the droppings from the eaves of any house or verandah to fall upon any footway. 9. Opening any drain or sewer or removing the surface of any footway or carriage road without authority from the Borough Council so to do.
10. Neglecting to clean any private yard way passage or aveuue by which nßglect» nuisance by offensive smell is caused.
11. Eolling. any cask beating any carpet breaking in any horse flying any kite usisg any bows and arrows or playing at any game to the annoyance of any person in any public place or obstructing any footpath or carriage road whether by allowing any cart or animal to remain across such footpath or carriage road or by placing goods thejpon or otherwise. .
12. Throwing or discharging any etone or other missile to the damage or danger of any person or property.
13. Having any awning on or over any footway in any public street or thoroughfare cot being,nine feet clear above the footway or obstructing the footway by the supports of such awning or voraudah or hanging any goods on or under such awning over the footway. 14. 'Blasting any rock stone or timber in or near any public place, without permission of the Borough Council so to do. 15. Furiously er negligently riding or driving through any public place street or thoroughfare. 16. Exposing in any public street or thoroughfare except in any fair or market lawfully appointed for that purpose any horse or other animal for show hira or sale.
17. Making any cellar door or other opening from the footway of any street or public thoroughfare without the consent or not in accordance with the directions of the Borough Council.
18, Discharging any firearms or carrying any firearms sword dirk dagger or other offensive weapon within the Borough without permission of the Borough Council provided that ths provision last? aforesaid shall not apply to any Justice of jthe Peace or any person in Eer Majesty's military or naval' service, or any member of the polfco or other peace officor or any mrmber of a recognised volunteer corps 6r^ any special constable, or any person actually in pursuit of any 1 felon or offender.
19. Any person laying out ov opening any Btreet or building therein and omitting during the operations necessary for forming such Btreet or for building thi rein to take all such precautions for guarding against injury to the passengers along such street as may bo necessary or as may be directed by the Borough Council.- • 20 Any person placiug any obstruction upon any street line whereby' life or limb is likely to be endangered. 21. Any person neglecting or omitting to keep in good repair any rail gate fence,, or cover over or about any area or entrance to any cellar or other place or keeping'open for more than a reasonable time for taking in or out any article any entrance "to any area cellar or other place (such area er entrance opening into or upon or near any public street road thoroughfair or other public place.) 22. Any person throwing any offensive matter or any animal with the intention of drowning it into any watercourse or-other. place from whence a-^upply of water for the use of the inhabit fin to of tho Borough is 6btamed. 23. .Any car! « I'icL-.g on any cart dray or |
waggon, without having and holding proper and sufficient roms and no competent person having charge of the animals or animals drawing tho same. . 2i. Any person driving any vehicle whatsoever or riding any animal and vrhen meeting any other vehicle ©r animal not beeping on the left or near of the road or street or when passing any other vehicle or animal going in the same direction not going or passing or not allowing any person desirous so to do to pass when practicable oa the right oi' off side of such other vehicle or animal. 25. Any driver of any horse or vehicle injuring any person or property whatever by negligence or by driving on the wrong, side of the road or by being away from his heree or cattle so as to be unable to have tho full control over them. / * 26. Any person driving any dog or goat harnessed or attached to any vehicle through any public place. 27. Any person who shall act as driver or have the sole charge of more than one vehicle on any public road or street. 28. Any person turning laoie any horse or cattle upon any public street or allowing any animal or animals to wander in any public street or thoroughfare within the Borough. 29i- Any person leaving upon any public street or thoroughfare any plough harrow cart or other vehicle without any horse or animal harneesed thereto unless in consequence of some accident having occurred.
30. Any person slaughtering or skinning any beast upon any public street or thoroughfaro or permitting any slaughtered beast or skin to remain there or leaving any dead beast on such street or thoroughfare.
31. Any person having any iron timber or boards laid across any vehicle going along any street or thoroughfara so that either end should project more than two feet beyond the wheels or fides of such vehicle.
*32. Any person destroying damaging polluting or obstructing any aqueduct dam sluice pipe pump w&tereourse or fountain. 33. Any person suffering or allowing any waste or impure water or other matter to remain in any cellar or place within any building or premises in the Borough or allowing any waste or impure water or other matter to run or flow from any suck building or. premises upon or over or be on any carriage or footway or other place whether public or private within the Borough or shall allow the contents of any water closet privy or cesspool to overflow or to soak therefrom so as to be offensive.
i§4. Any person being fclio owner or tenant of any building abutting any street where the footpath has been fownod who by oroitting or neglecting to secure and maintain the foundation of such building, causes or allews the formed footpath to fa'l in or be otherwise damaged. I- '
35. Keeping any disreputable house or house of illfamo or having the control conduct or management of the same or being a reputed occupier or an inmate of any such house. •
,<, 35A. Throwing or discharging any stone or other miasle to the date age or danger of any person.
358. Permitting any Stallion or Bull to cover within public view of any street or public placo.
36. The occupier of any property abutting on any footpath not keeping clean and in good repair the footpath in front of the property so occupied by him.
37. Setting or urging or parmitting any dog or other animal to attack or worry any person horse or other animal or by illusage or negligence in driving any cattle causing any mischief to be done by such cattle.
38. Any porion wilfully breaking asy pane of glass iv the window of any building or wilfully breaking extinguishing or injuring any lamp or wilfully injuring any lamp poat pump gas pipe water pipe fountain fireball stand or any public property. 39. Wantonly or maliciously defacing injuring or removing any door-plate bell .knocker sigaboard gate or other private property or wantonly or maliciously disturbing any inhabitant by ringing any door bell knocking at any door blowing any horn beating any drum uaeing any other noisy instrument, in any street or ringing any firebell. 40. Wilfully trespasang in any place and neglecting or refusing to leave such place after being warned so to do by the owner or any person authorized by or on belialf of the owner provided that this shall not extend to any person octing under a fair and reaionable supposition that he had a right to do the act complained of. 41. Any person who wantonly or cruelly beats illtreats overdrives overloads abuses tortures or omits to supply with sufficient food or water any animal. 42. Any person working on > allowing to work any animal incapable ov in any unfit condition to work by reason of lameness unhealed Bores shortness of breath or any other obvious physical incapacity. 43. Any person who keeps or uaos or acts in the management of any place for tho purpose of fighting or baiting any kind of any animal or bird or permits or suffers any place to be used or who in any manner encourages aids or assists at the fighting or baiting of any animal or bird.
44. Any person flaying at any game in any public street or thoroughfare on Sunday or keeping open any billiard room theatre or place of public amusmenton Sunday. 45. Any person, indecently exposing his 'person in or in view of any public place. 46. Any person who sings any obscene song or ballad or exposes to public view any obscene book print picture drawing or representation or writes or draws any indecent or obscene word figure or representation or uses any profane indecent or obscene language in any street thoroughfare or public place or within view or hearing of any person passing therein and any person wHo uses any threatening, abusive or Insulting words or behaviour in any public street thoroughfare or place with intent to provoke a breach of the peaGe or whereby a breach of the peace may be occasioned. 47. Any person placing himself in any public street highway court or passage to beg or gather alms or causing procuring or encouraging any child to do so. _ 48. Any persons soliciting gathering or collecting alms subscriptions or contributions under anyifalse pretence. 49. Any person imposing or endeavoring to impose upon any charitable institutien or private individval by any false or fraudulent representation with a view to obtain money or any other bonefit or advantage.

51. Erery person who shall allow any chimney of any house occupied by him to take • fire.
52. "Wilfully and wantonly removing any survey mark set up by any Government or Borough Engineer or ether public officer. 53. Any person found drunk and disorderly. . or drunk and incapable of taking care of himself in or upon any road street " thoroughfare or public place within the Borough of Thames. . ' ' • 54. Every person who, keeps or conductsr any public bowling alley skittle ground billiard room place for wrestling music or . dancing room shall register the same at the - . office of the Commissioner or other Officer of Police and shall close the same at the houm .
and time.severally appointed by the Council of the Borough of Thames and shall conorm to the rules prescribid by such Council or any second offence against this section shall be liable to be struck off the register and ■hall then be deemed unregistered' 55. Any person allowing in any home or placo -wherein liquors provisions or refreshments are sold or disposed of within the Borough of Thames any drunkenness or other disorderly conduct or suffer any gaming therein or "suffer prostitutes or persons of notoriously bad character to be assembled therein.
56. Any person being the owner or occupier of any stable or cowshed ; who shall allow the same to be in a dirty or filthy condition or who shall not lime white or white* wash the inside walls roof and ceiling thereof ' at least once in every three calender months. ■'
57. Any perion being the owner or occupier * of any stable or cow-shed who 'shall allow anj . ; manure or other offensive matter to accumulate - in or about such stable or cowshed.
58. Any person being the owner or occupier of any stable or cowshed who shall not cause the drainage of such stable or cowshed to flow by a properly made drain or shoot into a cistern' sunk to receive such drainage save on a certificate first had .and obtained from the Council of the Borough of Thames that such drainage is not necessary.
