Johnson and others, an appeal from the decision of tho Resident Magistrate at Gisborne, ordering appellant to pay JE2S damages for illegally setting fire to respondent's run at Poverty Bay, Judge Arney upheld the decision and dismissed the appeal with costs. In the case Riordan v. Tokatea Company, an appeal from the Warden's Court, which had refused appellant's claim to a site occupied by the defendant's machine, the argument turns upon whether the Warden was correct in declaring leaseholders' miners' rights valid miners' rights under "the Act of 1866.
