The brown heart appeal, cabled on January 2(i, was dismissed by a majority, with costs. Mr Justice Bnnkes, in delivering judgment, said there was no ground for imputing to the ship owners anv want or euro. In reference to the provision tor ventilation in .ships’ bolds there was evidence that the fruit bad been left on the tree too long, and that , might have bad a material effect in producing .susceptibility to disease. Mr Justice Scratton concurred. Mr Justice Atkin differed, bolding that appellants had established beyond doubt that damage to the apples hud occurred during transit.
