(Before W. Feaser, Esq,, E.M.) 1 Breach of the Fbiendly Societies' Act.—The case against James .Norton. 7 for withholding money the property of ' the H. A. 0. B. Society, which had been adjourned from the 28th ult., was ag&ia . called.—Mr Macdonald said that.whea. the case was formerly before the Court, there.were some points raised, and the. case was adjourned for settlement. There would have been a settlement if there hadbeen any sigu of the money forthcoming. They would offer no evidence, as the amount was not sufficient to warrant their going to expense of proving the existence of the society. Of course,, what other steps might be taken after he did not know.—Mr Tyler applied for costs oa the ground that they were brought here on an information which was not sustained. — His Worship said that the reason was so apparent. There was nothing held back. It was only through the mistake in the Gazette.—Mr Tyler' said that they denied withholding any money at all, and had no right here.— His Worship said that it was the defendant's business, as the secretary, to have • seen the society in a proper position. It was only in exceptional cases of this kind that costs were granted. He would not allow costs. The case was withdrawn.;

Assault —Robert Clements was charged; wifcli assaulting Jeremiah Dwyer on the 30th nit., by seizing him by the shoulder,pushing him about, and kicking him. There was no appearance of either parties, and the case was struck out.
