Tho Hon. James. Williamson has entered an action to compel the Improvement Commissioners to purchase, an allotment between Shortlaud and Fort Streets for £5,500, the amount of an award by the arbitrators under the Land Clauses Consolidation Act, on the ground that the award was the same as a judgment of the Court, and the Commissioners could not draw back. The Commissioners claim that under the Improvement Act they have power to withdraw upon giving three months' notice, which was done. The case is of great importance. It is not concluded. —The sale of race booths, gates, &c,, for Wednesday excited little competition. The gates fetched £95, and the grand stand bar. £14 10s. The booths were withdrawn.—Arrived: s.s. 'Phoebe ' from Southern ports.
