Maucious Injuay to Pbopeett.— Patrick Griflm was charged with unlawfully and maliciously breaking down part of a paling fence belonging to William Anderson, thereby doing injury to the amount of 10s.—Mr Macdonald for the complainant, and Mr Dodd for the defendant.—Jamea Stitohbury was. called,' but did hot appear.—Mr Macdonald said they could not go on with the case without him. He was properly subpoenaed, but said he would not come, and had kept his word.-William Anderson deposed that he served the witness with a subpce m that miming, but he sail he would not come unless he was properly subpoenaed.—The case was adjourned until Tuesday, to allow Stichbury to be subpoenaed.
