Labceny.—Edward Joneswas charged, oa remand from Friday, that he did, on the 7th. last., from the shop of John Townsend, Grahamstown.feloniously steal ' the sum of 6s, the property of John Townsend.. Accused pleaded hot guilty. < —Mr Bulleu said that as he had a more < serious charge to prefer against the pri- < soner lie would ask permission to with- ' draw the charge of larceny.—The charge was then withdrawn. Embezzdeheni.—Edward Jones was' then charged that he did receive and take < into his possession for, and on the account of his master, John Townsend, on the 1 4th May, the sum of £L 23 in money, and on the 27th April the further sum of £1, and ' the same did feloniously and fraudulently embezzle.—Mr Bullen opened the case, which was laid under the 68th section of the Larceny Act. He said that he understood there were other similar charges to be preferred against the prisoner.— Ellen Rowe, wife of Mr W. Eowe, Jun, residing on Tararu Koad, deposed: I know Mr Townsend, butcher, and the prisoner, who supplied me with meat, on account of Mr Townsend, for more than Bis months. I believe prisoner was employed by Mr Townsend, I only dealt with him on behalf of Mr Townsend, not on his own behalf. I dealt with Mr Townsend for meat during the month of April last. I recognise the account produced, I got it last Monday, I think, on the 4bh of May. . It was my bill for the month of April, the amount being £1 2s 3|d. I paid the aecused"£l 2s, leaviug a balance of 3|d. When I paid the money accused took' the bill, and receipted it, I believe. It was brought back to me by the accused next day receipted, by having written on it, "Paid* E. Jonesy/pro. J. Townsend," with some date in April, I cannot make out the'figures. I paid the prisoner Mr Townsend's monthly accounts before this occasion. I gave'che account to" : Mr Townsend, I believe, last Friday, in the same state in which I last got it from the prisoner.—Prisoner declined to crossexamine, the witness.—Sarah Oorbett deposed : I am wife of John Oorbett, residing in Upper Albert-street, Grahamstown. I know Mr Townsend and the accused. He has been delivering meat to me on account of Mr Townsend for about twelve months. supplied me during April. I recognise the aooonnl produced. It was delivered to me by the prisoner. It is an account of my indebtedness to Mr Townsend for £112 7|d. I paid the accused £1, leaving the balance of 12s 7|d due. I saw him receipt the account. That was this day fortnight. I gave the account to Mr Townsend I think on Friday last. I have been in the habit of,paying the accused Mr Townsend's account before this date.—Accused did not cross-examine.—John Townsend deposed: I am a butcher, carrying on business in Grahamstown, Accused was in my employ for the last 18 months. I paid him £1 per week and board. His, duty was to get orders, bring them in, and deliver the meat, and receive accounts when offered to him by my customers. Any money_ received on my behalf he was to book in the day-book, and' hand over to me. I know Mrs Rowe. The account produood is in my writing. It is the amountof Mrs Eowe's indebtedness to me for the month of April. I gave it to accused to deliver to Mrs Eowe on last Monday, I next saw the account on Friday last when I got it from Mrs Eowe. It had then the writing," Paid E. Jones pro J. Townsend, April 4,74" on it. It is in the handwriting of the accused. He did not pay that money over to me, or make any entry of it in the cash-book. I also know Mrs Oorbett, the last witness. She is a customer, of rntno. I recognise tho
second account. It is in my handwriting. It shows the amount due to me by Mr Corbett up to April 25th. I gave it to accused to deliver. This was a fortnight ago to-day. I next saw the account last Friday, when it was given to me by Mm Corbett. There was then written on it in pencil, " By cash £1, balanoe 12s '1\i. E. Jones, April 27, '74," in accused's writing. He did not hand that £1 to me, nor make any entry in the day-book. I went to see the prisoner at his request on the morning of the 8 th, after he was apprehended. He then gave me the names of persons from whom ho had collected money on my account, which he did not account to me, for. Amougst others the name.s of Mrs Rowe and Mrs Corbett.— Detective Brennan deposed: In consequence Qf information received from Mr Townsend I went in search of prisoner on the 7th instant, and found him that night on board a brig called the' Drover,' bound for Newcastle, New South Wales. He was in the hold of the vessel stowed away under some bags. _. I apprehended him on the charge'of larceny, which has been withdrawn. I asked him if he had received any money from Mr Townsend's customers which he gave Mr Townsend no account of. He said he had not. I then asked him a second time, repeating the same words. He said, '• I have, tell Mr Townsend to come and see me, and I'll give him their names." Prisoner declined asking questions.—Mr Bullen here asked for a remand for a week, to permit the police to make inquires regarding the other charges. i
