COURTS

POLICE COURT.— Saturday. [Before \7. ERASER, Esq., E.M.J CARELESS DRIVER. Phillip Warren was charged with being at such a distance from his vehicle, at ShorJaud, on the 24th instant, as not to have control over the horse drawing the same. Defendant was fined os and costs. NOT KEEPING PREMISES CLEAN. Archibald Somerville was charged by the Inspector of Nuisances neglecting to keep clean the premises occupied by him in Oweu-street, whereby a nuisance was created on the 19th instant. The defendant said lie was not in occupation of the premises at the time, and had been away from the Thames since June. Constable Brennan, the inspector, stated that lie inspected the premises on the day .in question. They "were in a very dirty state. No one appeared to be in occupation. They belonged to Mr Somerville. The R.AI. said under the circumstances lie would impose the mitigated penalty of Is and costs. Andrew Otto, restaurant keeper, was charged with a like offence in respect of his premises in Brown-street. Air Alacdonald appeared for defendant, who pleaded uot guilty. The inspector stated that he visited the defendant’s place on the 19th instant. There was a piggery with six or seven pigs in it in the yard in a very filthy state, and causing a most offensive smell. By Mr Alacdonald : Mr Otto has been here before at my invitation. I never

said I would work him. I won’t swear positively as to the number of pigs. The piggery was very dirt}’. Apart from the piggery I should have no complaints to make about the premises. For the defence, George Otto, son of the defendant, was called, and stntcd that before he went to school eveiy morning he cleaned out the pi <g-sty thorough!}’. M Icliael O’Brien stated that the piggery in Mr Otto’s premises was usually kept in a very clean state. There were 4 pigs in it. Is in the habit of seeing it daily. The R.M. said from his own knowledge of pigs he was aware the}’ could not bo kept in a town without creating an offensive smell, unless they were cleaned hour. There was no by-law to prevent people keeping pigs, and no doubt they were valuable adjuncts to a restaurant : still if the inspector did his duty, it would be found hardly profitable to keep them in the township. Defendant was fined 10s aud costs. John Harris pleaded guilty to a charge preferred against him of having the back yards of his premises in Queen-street in a dirty condition, aud was fined 10s and costs. Daniel Ormo pleaded guilty to a similar offence regarding his premises in Pollenstreet, and was fined in a like amount. George Iltilme was charged with a like offence. Mr Macdonald appeared for defendant, and -said his client could not appear as it was a market day. The R.M. said this was a lame excuse but he would adjourn the case until Monday. When the business was disposed of, and the R.M. had left the Bench, Mr Huhne made his appearance, but the matter was not re-opened, and the case stands over until Monday.
