WARDEN’S COURT— Yesterday.

Defora W. Fraser, Esq., AVaivlen. T. S. & W. Weston y. Yale of Avoca G.M.C. —Mr Macdonald nppearsd for plaintiffs; there was no appearance on the part of defendants.—Tins was an action to recover the sum of £l9l 7s balance of account for crushing quartz for the Company under an alleged agreement.—Thomas Sharpe, manager of Weston’s battery, deposed that he knows the Yale of Avoca’s ground. Weston’s battery lias been engaged in crushing for the Company, and has done the work mentioned in the hill of particulars. Has received payment on account. There is now a balance due of £l9l 7s.—The miners right of Messrs T. 8. Weston and W. Weston were put in evidence, also the certificate of incorporation of the Company.—No defence was offered, and the Court gave judgment for the amount claimed, with £8 9s costs. The Court then adjourned until Wednesday.
