WARDEN'S COURT— Yesterday.

Before *>V. Fraser, E*q., Warden. •T. T. Moikiax v. Ixtkri.uje No. 2 G.M.C'o. The plaint in this ease set fowh that the defendants are the registered owners of a claim on the Waiotahi Creek known as the “ Interlude No. 2.” and have neglected fairly to work the same during tiie period of occupancy and beyond the space of one working day immediately proceeding the day of the lodging of this complaint.— There was no appearance on the part of defendants.—Joseph Tyler Morgan, the complainant, produced his miner’s right, and stated that (lie claim had been unworked during the period of occupancy, and ho therefore sought to obtain possession.—Mr Burgess produced the register of the company. —Mr Lloyd, the bailiff of

the Court proved the service of the summons on the defendants at the registered office of the company, Graliamslown. — The R.M. adjudged that the defendants had forfeited the claim, and ihnt complainant be authorised to take possession. McTliione v. Penn. —The Warden said he had granted a re-hearing in tins case in consequence a statement made on affidavit by defendant and corroborated by Air Alclibone, that defendant had been misled by the latter as to the day of hearing.—Tho case (which was heard and disposed of the previous day) would he re-heard on Tuesday.—The Court then adjourned until Tuesday.
