WARDEN’S COURT.— Yesterday.
Before W. PHASER, Esq., Warden. Mcllhone v Quebec G.M.C. —In this case, the Inspector of Miner’s Rights charged the defendants with not holding a lease-holders Miner’s Right on the 13th 14th and 15th of October, during which period they were working the ground. Mr Miller appeared in support of the complaint, and' Mr Tyler for the defendants.—Mr Tyler said he was willing to admit the charge on behalf of the defendants.—The R.M. said the case had better be proved.—Robert Horne, legal manager of the Company produced the Company’s lease, and stated that they held no leaseholders Miners’ Rights on the days named.in the complaint, but the money had been lodged since, on the 20th.—Mr Robinson, Receiver of Gold revenue, stated that he was aware that a lease had been granted to the Quebec G.M.C., but could not say when it was granted. It was executed on the 9th August.—Mr Tyler submitted that a nominal penalty would meet the justice of the case.—The R.M. said he wished all the Company’s were as anxious to do justice to the natives as the Quebec appeared to have been. Under the circumstances, he would inflict the mitigated penalty of 20s and costs, although he had stated in a former occasion, that the fullest penalty would be inflicted in future, but this certainly appeared to be a case sufficient to justify him in mitigating the penalty.—The defendant was therefore fined 20s and £3 18s costs.
