CIVIL JURISDICTION. (Before his Honor Sir G. A. Abney, Chief Justice, and a common jury.) His Honor the Chief Justice took bis seat at 10 a.m., on the third day’s hearing of the action in MABsnAr.L V. Tiist Italian Goldjiining Company. —The .examination of additional •witnesses in support of the plaintiff's claim was made by Mr. Hesketh, but although the examinations and cross-exami-nations were of a elose and most searching character no. new facts were brought out bearing on the case. A witness named Hogan deposed to having been desirous that Erskine should be allowed to become one of the shareholders, but as the others objected he said no more about it. ErSkine had not taken any active part in pegging out the cl aim j ner in getting the lease.— Two witnesses, Power and’ Mclntyre, deposed much to the same effect.—This having concluded the evidence for the plaintiff, Mr. Hesketh applied for certain amendments to be made on the record. One-of them was to strike out the name of Tookey as a defendant t° the., action, and another to direct the jury to return a special verdict on a certain issue.—His Honor could not see his way to comply with counsel’s request, when Mr. Hesketh said he felt ho. was.not in a-position to go to the jury, and would therefore request that a nonsuit be entered for : the plairttiff. This then brought the action to an abrupt termination’ and with it the close of the session. \ The Circuit Court was • dissolved at 3 o’clock.
