The elder Deakin threatened to shoot Tulon, but eventually the boys left for the purpose of duck shooting At about two o’clock in tbe morning they came back and found ! ulon lying asleep. Without mure ado the elder Deakin fired bis gun at the fisherman, who received the con ents in the bead. By some means Tulon managed to get into his boat, which drifted down the stream. He was found and taken to the Wentworth Hospital, but shortly afterwards bis depositions were taken. There was not the slightest doubt as to tbe committal of the murder, and the jury returned a verdict to that effect, recommending tbo prisoner to mercy on account of his youth and previous training. The Judge sen tenced him to death, remarking that the murder was one of tbe most cruel ever perprtrated in New South Wales. Tbe prisoner received the sentence nomoved.
