Atthe Supreme Court, Christchurch, on Wednesday, Mr Stringer, on behalf of Luke Ferham, moved to quash the indictment for assault on the ground that the provisions of the Vexatious Idictment Act, 1870, Lad not been complied with. Accused had been charged with having broken and entered the dwelling house of one Sarah Mundy with intent to commit a felony and been committed for trial upon such charge. No indictment, however, was presented for burglary, the charge being altered to one for indecent assault, Mr Stringer contended that this course was not permissible. The Crown Prosecutor replied, contending that the proper course had been adopted. His Honour deferred his decision until later in the day, when he gave judgment quashing the indictment. Judge Gillies refused the application for a mandamus to compel the City North Licensing Committee to grant renewals of licenses to the four hotels they closed at the recent sitting.
