Deceased fell in front of the wheels of the truck and it passed over him, horribly mangling him. Death was instantaneous.
At the Supreme Court, Christchurch, on Thursday, before Mr Justice Ward, the casa of Jones v. Spence came to a close. Jones travelled as groom with entire horses belonging to Spence, and had done so from (he season of 1883 to that of 1885. In 1888 Spence caused Jones to be arrested on acba f ge of arresting certain fees. Jonss was brought before a Magistrate and imprisoned. Ultimately he was committed for trial for ernbezzbmeat on three separate charges. When the Supreme Court came on Jonea was acqniit°d on one charge and a noth prosequi was entered on the other two. On the' pl-ia (hat the; charges were f«l e and malicious, and that the imprisonment was wrongful, plaintiff ■ought to recover the damages of £IOOO. j The defence throughout was a plea ofj reason ble justification for the whole pro-' cednre, and (he assertion that in certain specified cases plaintiff had actually! received fees for horse services and had not accounted foi them. Ic the coarse of the evidence it came out that several leaves were missing from the book kept by Jones, but by whom these leaves were extracted did not very clearly appear. It was also shown that Jones at Rangiora show had been guilty of exhibiting a foal as the progeny of the horse OhancaHor, which was not by that horse. Jones had received no money prizp in this competition, otherwise said the Judge, he would have been liable to indictment for obta ninf money under falie pretences. After a lengthened hearing, and a full hone’s address by Mr Bowman, judgment was given for plaintiff on all the counts with £7O damages. Mr Holmes gave notice, in defendant’s interest, to move for a new trial.
