Important Insubanob Cash. —ln the Supreme Court, Dunedin, on Friday, Mr ' Justice Williams gave judgment in the case of Bowers v. the .National Insurance Company, a cliim on an insurance policy. The insurance was over the house and furniture in it. The Company paid the insurance on the furniture, but elected to rsinstile the | building j but, the plaintiff having alienated the laud, they were prevented from reinstating. Plaintiff contended that, having paid for the furniture, the Company oould not elect to rein-tate the building. His tlonor held that if a man's houseandfu.-nilure wereinsured, and both burnt, clearly the amount of his losswas Mie value of the two together, and it could never have been intended to allow a Company to choose at pleasure some item*, and say " These we elect to pay for." Looking at the nature of the contract, and at the fact that the condition does not dearly give the Company the right to reinstate a part", they had by paying for part lost the right of eleclion to reinstate, and that they must pay for the rest. Judgment was given for £IOO, disbursements, and witnesses' expenses. Both Wright and Findlay had passed round before Flint got the stilt, and consequently in beoame necessary for him to pass twice before winning. This was very difficult, as the rules required passing on the ontiide, and a good deal of ground is lost. Findlay pacsed Wright once, *nd Flint passed him twice, but failed to pais Findlay the second lime. J. Findlay, junr, a lad of about 16, won a very hard woe, with nothing to spare.
