Application for an order of discharge. Mr Toss will fop applicant} Mr Raymond 7 appeared on behalf of certain creditor* to '■ -opposed ■ r v, W. Wheelband, on being an ora, said he owed his wife £IBO. He received £6O from her about nine years ago, ,£3O from her sister about 2 years ago, and £IOO i When f Ws went there for his health, and to get some money for his wife. He bad not received any money from his wjfe since he cume from England. ' Barrett was a debtor to whom be, had paid'largo sums of money. Witness met Mr Pbstleth waite in England, and asked him to send him out some glass which he did. He said that he would pay for ; it'; when it was landed in New Zealand, and t'liat Jpa bad come to England to get some money for his wife. He also owed Mr Poatlotbwaite £4OO on A mortgage, and. gave him 350 pigs on account of it. He borrowed £SO from Mr.Hayhursl, and told him that be j wanted to meet;one or two debts, which be did. r . Another time he tried to get £250 through Hamersley. ..Gray was the valuator. \ ' James Granger, account'ajdt, Timaru, and W. O. Bsswick, Deputy” Official Assignee, gave evidence as to tbs' bankrupt’s books which they did not consider were properly kept.; '•* •■■■' - W, Postlethwaite staled that be saw the bankrupt in LiuJ o a", and there arranged to send hiui but sdirie glass for a conservatory,’ tyhich the’ bankrupt agreed to pay for on; its arrival in New Zealand, but that the had not been paid as agreed.., In cross-examina-tion the witness said the account attached to the proof of debt by hint (Mr Postletbwait), showed that the amount for glass had been settled by the sale pf 97 pigs, sold on account of the bankrupt by witness. W. Hargreaves, J. I’. M. Hay hurst, W arid J. Brown were called, but were not--allowed to give evidence, an objection by Mr Tosswill that their proofs of debt were not in accordance with the Act being upheld. J. Barrett and H. Goodeyjhaving given evidence, His Honor stated he would suspend the order for nine months; order not to take effect until the costs of the assignee, and the costs of the opposing ■ ' creditors, which he* fixed .at £3 4a, had been previously’paid. Re Thos. Birrell, Recessed. Mr Lynch, for Mr Kniibloy, applied for the issue of letters of administration to Peter Birrell, the father of dieoeased.—Order granted.
