EMBEZZLEMENT.
Craig M 'ginnis was arrested at Lake Heron on Friday last, charged with embezzling certain moneys, the property of his employer, and on being brought up at the Ashburton Court was remanded to Timaru. Yesterday the accused was brought up at Timaru, Mr J. S. Beswick, R.M., being on the Bench, and the South Canterbury Times gives the following account of the proceedings Craig Magionis was, charged with embezzling from his master, Joseph Ivess—(l) £3 9s on December 7, (2) £2 I7s 6d in the month of November, (3) £3 6s on December 6. Mr Tosswill appeared for accused and said he was informed tba< the prosecutor desired to make a statement to the Court which would place the matter on a different footing. Joseph Ivess said ho wished to inform the Court that the accused had sent him an order for the whole amount of the apparent defalcations. At first he thou.ht ihe order valueless, as it was drawujon a person at Home, but he hud since learuod that was not the case, the order being negotiable in New Zealand. Under the circumstances he (prosecutor) would, with His Worship’s permission withdraw ihe charge, as he had no desire to prosecute. His Worship said auch being the case he would dismiss the information, No doubt accused 'ought to have paid over the money, but still, as he had given an equivalent, hi did not see his way clear to insist on the prosecution.
