CIVIL SITTINGS. [Before His Honor Mr Justice Johnston, and a Jury of four.] The Supreme Court was occupied all Monday hearing the ease, of B nee’-* Oatmeal Milling Company versus E. .Wakefield, ;; Mr joynt, with Inin 'Mr Hay, appeared for the plaintiffs, l : aiid Mr White, ;; with him Mr Knubley, for the defendant. The defendant is the owner i f a section in Timaru fronting the: rail way,: and tba plaintiffs, believing that Tlios. Hull was his agent, bought the secti.on for.the purpose of erecting a mill, and "paid Hall £3OO, which he did not* account for. Before Hall’s arrest they had also done a considerable amount of excavi’tmg, Defendant said that all Hall hnd Meason were authorised to Bo for liitn was to collect the rent of two houses and transact some, insurance business. When Hall wrote to. him on the- subject lie told him not to receive mom-y for the section named, as it must all-go to jhe mortgagees, *nd he gave no instructions to: prepare the lransfer deed. His Honor adiourned his decision till Tuesday, when he gave it in favor of the plaintiff's, holding (hut Hall was authorised to receive the money. Unless a title were given. to the . land within one month, Wakefield would have to pay £3OO with 8 per cent interest. Costs would be allowed on the midd'e scale, and the fees if second counsel would have to be paid. . .. The Court then rose. , ~V " * ’
