Farrell, sworn, stated tho items in the account were fair charges. To defendant; In making an affidavit that you were leaving the district I went upon what I had heard. You took your thing# out of the house without telling mo you were going to leave. I did not ask you for more money when you paid me £5 on account on August 14th. I was not aware you wer# taking your things from my place, and I did not hear yen ask a friend of rain* to help you to remove them. I saw you take an overcoat away. Chas. A, Lloyd, swam, stated : Sinn* August 20th, 1884, I have paid plaintiff over £6O for board. The present claim is for £ll 2s lid. I have a contra against this of £1 13s 6d—for photographs £l, and value of ahirt loar in washing 13s 6d, I have been ill for six or seven weeks and have been unable to follow op my business of photographer. I admit the claim, but wish for time to pay it. lam not leaving tho district. To plaintiff : There was no agreement between us as to who was to be responsible for articles lost at the washing. You asked me to take charge of the billiard room when you went home. You did not ask mo for the money before this action was taken. You never said you wanted the whole before August 15tb. Plaintiff admitted the £1 for photographs, but not the ISs 6i for the value of the shirt, as he was not responsible. In reply to the Bench ha stated he was not willing to taka the amount in instalments as he believed defendant was leaving the district. Judgment was given for plaintiff for £lO 2s lid and costs. The Court then rose.
