Whereas by Section 36 of the Town District Act, 1881, the Board is empowered to make By-Laws in manner provided with respect to Borough Councils by Part XH. of the "Municipal Corporations Act, 1876," and in relation to any matters comprised therein, the said Part XII., together with any enactment passed in amendment of any of the provisions contained in the said part, shall apply to any By-Laws made by any Board under this Act in relation to any of the aforesaid matters. 1. Any person wishing to erect a verandah or portico over any public footpath must, previous to commencing such verandah or portico, obtain from the Board a written permission to do so. All verandahs or porticos to be erected over any footpath shall be at least eight feet high, and shall extend to the kerbing of the footpath, and be erected to the satisfaction of the Town Board- and the upright pillars or supports shall not be less than six feet apart ; and the surfeit or sign-board over the front shall not exceed two feet, and shall be erected above the wallplate so as to leave a clear space of not leas than seven feet from the kerb of the footway to the lower edge ot such surfeit or signboard ; and the roof of such portico shall consist of iron or other incombustible material. 2 No person shall open any dram or sewer, or remote the surface of any road or street, without lawful authority. 3 The owner or occupier of any land or building shall construct, and shall at all times thereafter maintain in good order and condition, gutters, spouts, and drains, so as to prevent, any water from such land or buildings falling upon any street or footpath. And all crossings over side-channels and footpaths shall be constructed under the supervision and approval of the Works Committee or any officer appointed by the Board, and kept in good order at the expense of the owner or occupier of premises using the same. . .. ... 4.
