11Y-LAW NO. 2 of the TEMUKA TOWN BOARD. Whebbas by SbCtion 36 of the Town District Act, 1881, the Board is empowered to make By-Laws in manner provide; with respect to Borough Councils by Part XII. of the Municipal Corporations Act, 1876,” and in relation to any matter* comprised therein. The common seal of the Town District shall not be affixed to any document except in the presence of the Chairman and Clerk, or of two Commissioners specially authorised bj resolution of the Board for that purpose. 2. Any person wishing to erect a verandah or portico ovei any public footpath must, previous to commencing such verandah or portico, obtain from the Board a written permission to do so All verandahs or porticos to be erected over any footpath shah be at least, eight feet high, and shall extend to the kerbing of the footpath. 3. No person shall open any drain or sewer, or remove ttu sin face of any road or street, without lawful authority. 4. The owner or occupier of any land or budding shal. cor struct, and shall at all times thereafter maintain in good order and condition, gutters, spouts, and drains, so as to preven* any water from such land or buildings falling upon any street or' footpath. And all crossings over side-channels and footpaths shall be constructed under the supervision and approval of ihe Works Committee or any officer appointed by the Board, and kept in good order at the expense of the owner or occupiei of premises using the same. 5. Ail drains under footways shall be constructed with such materials and of such dimensions as the Works Committei or any officer appointed by the Board may direct, and shall bt laid with a fall of three (3) inches in the whole width of th. footway, the level of the discharge mouth being the level of tht water channel. 6. No owner or occupier of «ny premises shall allow the discharge of any offensive matter whatever into any street oi publ’6 place, , “7. Every person before beginning or making other preparations for any buildings, any portion of which, when built, will abut on any street or footway, shall deliver at the Town Clerk’s Office notice in writing to the Board of such his or her intention. . . . 8. Such notice shall describe the intended work, and specify the height, depth, extent, and position thereof ; and shall also state whether or not it will be necessary, for the execution thereof, to construct any scaffolding or depos t building materials upon the street or footway, and if so, for ho» long. • 9. The Board may, after having received any such notice, grant to the person giving the same a license for the erection of scaffolding and the deposition of building materials, and such license may be extended by endorsement under the hand of thi Town Clerk. 10. A fee of five (5) shillings per month shall be paid to» every such license, and every such license shall be renewed from month to month. 11. Any person erecting any scaflolding or depositing am building materials or any other obstructions, upon any street oi footways hall, before doing so, put up such hoarding and fences aishall be approved of by the Works Committee or any officer appointed by the Board, so as to separate such scaffolding, building materials or any other obstructions from the rest of the street or footway ; and shall so maintain the same and keep the same properly lighted, to the satisfaction of the Work* Committee or any officer appointed by the Board, between sunset and sunrise, whiist such scaffolding, building materials or other obstructions shall be so constructed or deposited. 12. Every person licensed to erect any scaffolding oi deposit any building materials or other obstructions, shall, at the expiration of such license or in the last renewal thereof, remove such scaffolding, building materials or other obstruction, and shall make good the footway or street to the satisfaction ol the Works Committee or any officer appointed by the Board. 13. No person shall draw or trail any sledge, timber, oi heavy material upon or along any street or road, to the injury of such street or road. 14. No person shall erect any building, fence, hedge or
