RESIDENT MAGISTRATE’S COURT.

Temuka—Monday,- Dec, 10,1883. [Before J. Beswick, Esq., R.M.] BREACH OF THE PEACE. John Birosnaban, Timothy Foley and John McKenna were charged with having committed a breach of the Peace Act, at Arowhenua, on the 27th of November. They admitted the charge, and were fined LI and costs each. ASSAULT. John Craig was charged with having assaulted W. R. Uprichard on Friday last, Mr Craig was not in attendance when the case was called upon, but Mr Haraersley, who appeared on bis behalf, obtained the consent of the Court to adjourn the case for a few minutes to give time to send for Craig. His Worship agreed to this, and said if he were not in attendance when the other cases were heard, he would issue a warrant for his arrest. At a subsequent period when Craig appeared, he said in reply to the Bench that he had been 100 busy all the morning. His Worship : And is that all the excuse you have for absenting yourself when summoned to appear before the Court in an assault case ? Mr Craig ; Yes, your Worship. I could not turn customers away. His Worship ; I shall consider what I shall do with you. Go on with the case. The evidence of the complainant, defendant and Joseph Whitehead was to the effect that on Friday the complainant wished to sell some tickets to men employed by Craig, and that Craig ordered him off the premises. The reason assigned for this was that some two years ago the complainant collected some accounts for defendant, and that since then they were not friends. The defendant said the complainant was laughing and sneering at him, and asked him to have a glass of beer. He did throw a stone at complainant. The Bench fined defendant 20s and costs, and made him apologise for his absence in the morning. CIVIL CASES. J. M. Ollivier v. 1). Heffernan— Claim LlO 9s, John Garland proved that he had cashed a cheque for the defendant. Ordered to pay at the rate of 10s per week or in default one month’s imprisonment. The Court then adjourned.
