AWARD OVERRIDES CUSTOM.

The Magistrate, Mr. Meldrum, gave his reserved decision to-day in the case in which numerous Blackball miners were proceeded against by the La oui Department for refusing to observe the-provision in the award that the full eight hours be worked on pay Fridays and back Saturdays. The miners contended that the award was opposed to the recognised district custom. Mr. Meldrum convicted defendent in the test case, imposing a fine of £1 with costs, declaring that an award overrides any custom inconsistent with the of'the award. The proper place to get the custom recognised was the Conclli afion Council or Arbitration Court. Xie Court was bound by the award, a could not go into the merit, of the custom. Leave to appeal was granted.
