SALE OF A FARM.

ALLEGED MISREPRESENTATION VERDICT FOR DEFENDANT. After a sljort retirement the jury returned a verdict for the defendant in the claim made by George Olbert Hurrell and others versus William Andrew Officer for £3300 damages for alleged misrepresntation in the sale of a farm at Mokoia. The hearing was commenced last Wednesday, and the whole of that day and Thursday and Friday were taken in hearing evidence. On Saturday morning the Court sat at nine o’clock, when counsel addressed the jury and His Honor Mr. Justice Chapman summed up. Counsel for the defence (Mr. F. S. Spratt) addressed the jury at some length, traversing various portions of the evidence, while Mr. P. O’Dea (for the plaintiffs) also spoke for about forty minutes. His Honor’s summing up was mostly confined to the law on the subject of fraudulent misrepresentation, and hi = remarks were similar to those he made in the case Dutton versus Upson, which was heard earlier in the session. He then proceeded to review portions of the evidence. The jury retired at 12.30 p.m. and returned at one o'clock with a verdict as stated. Judgment was entered accordingly. Costs were awarded at £l5 15s per day for the second, third and fourth days, with witness’ erpenses and disbursements to be fixed by the Registrar.
