MAGISTRATE’S COURT.
NEW PLYMOUTH SITTING. A sitting o£ the New Plymouth Megistrates’ Court was held yesterday, Mr. A. M. Mowlem, S.M., presiding. JUDGMENT FOR PLAINTIFF. Judgment for plaintiff by default was given in the following cases: P. B. Fitzherbert v. Riakiao Rangiwanga, £2l (costs £1 18s); John Avery, Ltd., v. W. H. Thomas, £8 8s Id (costs £1 8s 6d); Gordon Salway v. Dick Carroll, £lO (costs £2 16s 6d); J. B. McEwan and Co., Ltd., v. T. C. Simson, £lOl Ils 5d (costs £6 7s); Archie Hooker v. Chas. Torkleson, £1 6 a (costs only). LIGHT-WEIGHT BREAD. A number of cases were brought against New Plymouth bakers under the Sale of Food and Drugs Act and the Weights and Measures Act. Lionel Percy Ford was charged by the police with selling underweight bread on April 12, 1922, and was fined £lO (court
costs 7s, cost of purchase of loaf Is). The inspector of weights and measures (Mr. W. J. Mountjoy) also laid an information against L. P. Ford for using and having in possession on the same date unjust weights and weighing-machine and an unauthorised weight. Defendant pleaded guilty, and was fined £5 (costs 7s). On a similar charge G. H. Gallagher, who also pleaded guilty, was fined £5 (costs 7s).
BREACH OF PROHIBITION ORDER.
Herbert Leonard Coleman, who pleaded guilty to a charge of procuring liquor while a -prohibited person, was fined £1 (costs 7s), and on a further charge of being found on licensed premises while a prohibited person he was convicted and discharged.
BY-LAW CASES.
Inspector McGahey (Taranaki' C.C.) laid an information against Fredk. Smith for allowing a cow to be at large on a public road, and defendant was fined 10s (costs 7s). George Bartholomew, for cycling without lights at night, was fined £1 (costs 7s). Inspector Day laid the informations in the following cases:— For cycling on footpaths, Raymond Webber was fined 10s (costs 7s); Alex. Korff, 15s (costs 7s), and Wm. Ladnor £1 (costs 7s). Claude A. Marchant, for leaving a car in Carrington Road without proper and sufficient lights, was fined £3 (costs 7s).
MAINTENANCE CASES.
An order for separation and maintenance, on the grounds of failure to maintain and persistent cruelty, was applied for by Isobel Daisy Atkinson against Marmaduke Atkinson. An order for separation was given, maintenance to be given at £1 weekly. Valentine Biggin was charged, on the application of Cecil Elizabeth Ida Biggin, with the disobedience of an order under the Destitute Persons Act, the arrears amounting to £36. Defendant was sentenced to 14 days’ hard labor in the New prison, the warrant to be sus- ' ended so long as defendant paid current aintenance promptly and in addition the n of 10s off the amount of arrears unthe arrears are fully paid up.
