MAGISTRATE’S COURT. BREACHES OF ARMS ACT. (From Our Own Correspondent.) May 1. A sitting of the Magistrate’s Court was held at Eltham to-day before Mr. A. M. Mowlem, S.M. Kaspar Schmidt, of Manatoki, was charged with being in possession of an unlawful weapon, viz., an automatic revolver. Constable Townsend said the accused had presc-ited the revolver for registration, saying it was given him in January last by a man who had returned to his home in Switzerland. Mr. A. Chrystal, who appeared for the defendant, said almost as soon as Schmidt came into possesion of the weapon he brought it to the police for registration and was immediately charged with being in possession. His Worship said he had no option but to convict defendant and order him to pay costs. The weapon would be forfeited.
G. W. Hayward was charged with having a breech-loading gun in his possession without a permit under the Registration of Arms Act. The Magistrate said the law was very stringent on this point and an offender was liable to a penalty of £5O. Hayward was convicted and ordered to pay costs 7s. CIVIL CASES. Judgment for plaintiff by default was given in the following undefended cases: —G. W. Peebles v. N. Hill, £lB 10s (costs £1 8s 6d); Bert G. Tayler v. Harry Hodge, £7 7s (costs £3 4s); J. N. Bethell v. D. R. Savage, £2 8s 9d (eosts £1 8s 6d); Eltham County Council v. Arthur Foy, £45 Ils 7d (costs £3 Is 6d); Joseph Taylor v. H. F. Voitrekovski, £l4 2s Id (costs £2 17s); Percy W. Allen v. Henry Martini, £9 13s 6d (costs £1 10s 6d); J. H. Bodie v. Louis Murray, £4 (costs 13s) ; same v. H. Yeates, £6 Ils 6d (costs 15s); Egmont Box Co. V. D. Meier, £1 13s costs only. In a judgment summons case Clifford Day was ordered to pay J. H. Bodie £4 9s forthwith, in default five days’ imprisonment, the warrant to be suspended for seven days after service of the order. Frederick George Brinson, farmer, of Toko, claimed £45 7s lid from George Alartin, farmer, of Eltham, for an alleged breach of warranty in respect to the sale of a cow. The claim included £l7 loss on the resale of the cow, grazing £3 7s 6d and loss of milk for the season £25. It was claimed that a warranty had been given that the cow would come into profit at a certain date, and this warranty had not been carried out. After lengthy evidence had been heard the Magistrate gave judgment for plaintiff for £24) 7s 6d. William Free, charged with driving on the wrong side of the traffic dome in Bridge Street on April 8, was fined 10s, ) with costs. —
