Mr. O. G % Thornton, assistent engineer, Public Works Office, Kapuni, wrote acknowledging receipt of the council’s letter warning the department that extraordinary damage was inflicted on the Oeo Road by one of its motor lorries carting shingle. In reply he stated that only 200 cubic yards was so carted, and this was completed before the receipt of the council’s letter. No further heavy carting would be done on the county by-roads for this season at. least, the lorry having been sent away to work in Clifton County. The letter was received. Mr. G. H. Richardson, audit inspector, New Plymouth, forwarded advice from the Crown Law Office that the Taranaki Farmers’ Mutual Insurance Association had no statutory authority to insure either against/ fire or accident other than that expressed in the 1908 Act and as amended by the Act of 1913; that local body properties and employees did not come within the category; that the council’s insurance was therefore an invalid one, and could not be pursued" in the event of loss. Unless the policies were formally cancelled, and at once, thus disposing of the contingent liability of the council, the Auditor-Gen-eral would take such measures as the. Public Revenues Act directed to surcharge members with the premiums paid, and ttk enforce an adjustmen u of the position. The council’s policies were returned with the letter. On the motion of Cr. McKay’ seconded by Cr. Long, the clerk was instructed to take out new policies with the National. Mutual Company.
