OVERCHARGE ALLEGED.

AUCKLAND FIRM IN COURT. DUE TO A MISTAKE. By Telegraph—Press Association. Auckland, Last Night. The hearing of a charge against Tonson, Garlick, Ltd., alleging overcharge on a number of mattresses supplied to F. J. Williams, sheep farmer, of Waipare, concluded in the Police Court today. Ernest P. Carter, officer in charge of the Auckland Board of Trade, said one of the reasons given for the overcharge was that the warehouse clerks, thinking the selling price on the factory docket was the actual cost, added the usual profit. The evidence of the secretary to the company was that a change in the system had been introduced, the mistake occurring during the transition period. Evidence was called to show that the material was supplied at less than replacement value. The magistrate said he had to decide whether the overcharge was the result of a mistake or a deliberate act. The prosecution, he said, considered the various explanations were so inconsistent that they had reason for suspicions, but taking all the facts into consideration he was of opinion that the overcharge had. arisen over an innocent mistake. The case must therefore fail.
