APPEAL COURT.

A DIVORCE CASE. By Telegraph—Press Association. Wellington, Oct. 10. The Court of Appeal this morning delivered judgment in the divorce suit of Mason v. Mason, an appeal from the judgment of Mr. Justice Herdman ia Christchurch in dismissing a petition for divorce by the husband, Andrew James Mason. The ground for the petit.on was that the parties had been separated for more than three years under an order obtained under the Destitute Persons Act. Mr, Justice Herdman dismissed the petition on the ground that, petitioner was partly to blame for the separation. Mr. Justice Salmond delivered a judgment which disagreed with Mr. Justice judgment, and the appeal was therefore allowed and petitioner declared to be entitled to a rule nisi for the dissolution of the marriage.
