He counter-claimed for .£3 4s for de murrage, storage and cartage of the blocks which he had not used.
Mr. Moss stated that Boon had relied on Woodham’s statement that the timber was comprised of house blocks. He had urgently needed the timber and when it arrived the first two dray loads from the trucks were cut up and sent out to jobs., but then the poor quality of the logs after the first two dray loads caused defendant to cease cutting. The amount cut did not comprise more than was necessary to test the goods. Mr. Coleman said that the consignment was indivisible. It Had been delivered to Boon as a job lot of blocks and Boon had endeavored to make a new contract offering 7d for the blocks he accepted and 3d for those he rejected. This he could not do without Woodham’s consent, and Woodham had stated in evidence that his price for the logs used would have been 9d. Mr. Richards said he wished something done to further the productivity of the hilly back country. There was a model farm at which anything connected with arable land could be touched on, but there were thousands of acres of good land which could be made productive. Stratford was the centre of the district, and he thought th* Department of Agriculture would help with a scheme. He thought it was possible to change the land into fat lamb country. If they could once demonstrate that the land could be made profitable it would he greatly taken up. The problem of the hili country had not yet been solved, and it was in the interest of everyone in Taranaki to solve itIt was decided to communicate with the Department of Agriculture with a view to helping to assist in increasing the productivity of the hilly country of Taranaki.
