A PICTURE AGREEMENT. At the. Opunake Magistrate’s Court on Wednesday, before Mr. A. M. Mowlem, . S.M., Marjorie Elizabeth claimed from L. Whiting £2lO ror breach of contract, alleging that in June, .1921, she contracted with defendant as pianiste and conductress of the picture theatre orchestra at a salary of £2 10s a week, and on August 2, 1921, cancelled the same. Plaintiff also claimed £-2 10s t for several practices in preparation for her duties.

Mr. 11. B. Gibson, in outlining the case for the plaintiff, said Whiting had engaged Miss Winstanley by a verbal agreement made in the street. Later defendant had entered into a contract with plaintiff to play at the pictures and had since broken the contract..

Mr. C. % O. Edmonds, for the defence, said that since Miss Winstanley was engaged from night to night the engagement could be .cancelled with one night’s notice.

His Worship held that if a contract was broken, nominal damages should be allowed, an amount for the court to assess. The arrangement made appeared to have been properly stated to the court. Without any real reason the defendant had 'broken an admitted agreeiment. Judgment would be given for plaintiff for the sum of £2, with court costs 'l6 s, witnesses’ expenses 7s, and solicitor’s fees 16s. ’ MAGISTRATE’S COURT. At the sitting of the Magistrate’s Court on Wednesday, Mr. A. M. Mowlem, S.M., was accorded a welcome by Mr. H. B. Gibson on behalf of the local bar. In a case in which the Health Department proceeded against Arnolds for selling lemonade containing saccharin, a fine of° £3 was imposed with costs 19s 6d. On a similar charge, Wai Yep and Co. were fined £2, with costa 12s 6d.

For failing to clear blackberry from his property, George Rrtai was fined £5, with costs 7s and translation for ss. In the adjourned case of Wright Mitchell, of Kaponga, v. William Daley, wherein plaintiff claimed £2 for the hire of a horse and £lO damages for alleged retention of the horse after the expiry of the term of hire, judgment was given for plaintiff for the £l2 claimed, defendant to have the right to apply for a rehearing within 14 days.
