SALE OF ELTHAM HOTEL.
APPEAL COURT'S DECISION. By Telegraph—Press Association. Wellington, Last Night. The Appeal Court gave judgment to-day in the case of Gant versus Fanning, which was heard on July 14, being an appeal from the judgment of Mr. Justice Reed, The case arose out of a claim by Fanning for a commission of £l5O on the sale o! an hotel in Eltham. Mr. Justice Sim, Acting Chief Justice delivered the judgment, in the course oi which he said the contract for the sale ww rescinded, not because of a defect in the contract, but because of a disagreement between the parties and by mutual consent. Fanning had found a purchaser who was willing to purchase on the vendor’s terms, and the vendor’s own conduct had led to the non-completion o f the sale. The appeal, therefore was dismissed. The result is that Fanning obtains jidgment for hie commission.
