CLAIM AND COUNTER-CLAIM Arising out of a collision between a tootor cycle ridden by Leonard Hill and a motor ear driven by S. B. Hunter, both of Stnttford, at rhe intersection of Broadway and Opunake Road on April 19, Leonard Hill claimed £l4B 12a damages, tor loss of wages, etc., and Ronald. Bill, the owner of the cycle, £74 16s for damages to the cycle, from Hunter. Heater put in a counter-claim for £-181 54s for damages to the car and genera] damages. Before proceeding with the case the Magistrate adjourned the court to allow of the scene of the collision, within a short distance of the courthouse, being Inspected. ■Mr. Coleman (for plaintiff) said plain* 5-iff was proceeding northwards along .Broadway on his correct side of the road. (Hunter's cat was proceeding southward pn the centre of the road. When nearfag the intersection of Opunake Road and Broadway Hill he was under the impession that Hunter intended to con* jtinue along Broadway, as he gave no in* of his intention to turn into the Ppunake Road and no warning was (rounded. After noticing that Hunter’s ear was turning ento the Opunake Road Bill Swerved still further to his left (With the intention of getting into the Ppunake Road in front of Hunter. It Ipras impossible to pass behind the car fend too late to avoid a collision. L Plaintiff gave evidence on these lines. Cross-examined by Mr. Cookes, Hili id that the doctor’s certificate had a bowed that he suffered from nervous* ness since returning from the front, but he had recovered.
