S.M., to two terms if imprisonment for procuring liquor while prohibited. The uicensirg Act fiSred the maximum penalty a£ £loj in default three’months, but the magistrate had given no option. Counsel urged that the magistrate had no jurisdiction to issue the warrant under which the man was held. Mr. Justice Adams made a rule nisi calling upon the gaoler to show cauw why the accused should not be dia* charged, the rule to be returned by Sat* urday.
