MERCHANT ON TRIAL.
MANSLAUGHTER CHARGE FAIU.
THE WELLINGTON CASE.
By Telegraph.—Preu Aueciation.
Wellington, Last Night. In the manslaughter charge against Guy Jxjßlie Fulton, of Wellington, merchant, a verdict of not guilty was returned. More than usual interest was manifested in the case, and the court was crowded with business men.
On the point of contributory n«iigence, his Honor held it not to be an excuse. In criminal law the onus would rest on the defence to prove that such negligence had created the critical condition. It had also been contended tha( the original injury was not dangerow to life, the medical testimony being that deceased would have lived had the operation not been performed. His Honor said that if the injury which caused death occurred subsequent to the medical treatment, which was applied in good faith, it did not exonerate accused, and whether the doctors did their best was a question for the jury.
