A BUILDER’S CLAIM.
SUPREME COURT ACTION.
CASE NOT CONCLUDED.
The case of Frank T. Crimp v. Ada C. Dunbar, in which plaintiff claimed £302 19s, being balance allegedly due for building a house, was not concluded when the Supreme Court at New Plymouth rose shortly after mid-day on Saturday. The facts, as stated for plaintiff at the hearing, were that he gave an estimate of £l4OO as about the cost of the house, but defendant had made a number of requests for alterations and “extras” during the work, which had increased the cost, and which he claimed he should be paid for. Further evidence was given by Alfred Crimp, plaintiff’s brother. For defendant, Mr. F. C. Spratt said the claim for extras really arose out of the fact that defendant who, of course, was interested in the erection of the house, paid a number of visits during the construction, and made complaints to Crimp of several matters which were not being attended to. That they were not extras was shown by the fact that when the original proposals were gone through Mrs. Dunbar’s husband made notes of the alterations, which he handed to Crimp, along with the rough draft, to draw up specifications. Proper specifications were never prepared, and Crimp was claiming for work which defendant had included in the original scheme for the house. Hearing will be resumed this morning.
