NEW PLYMOUTH SITTING.

At a sitting of the New Plymouth Magistrate’s Court yesterday judgment for plaintiff was given in the following eases:—

Wm. Pellew v. Willie Pratt, £6 8s 2d (costs £1 19s 6d); F. S. Butler v. Bruce Joll, £9 is lid (costs £1 Ils fid); Snelling and Andrews v. J. Parker, £1 7s 6d (costs 16s); Newton King, Ltd. v. Geo. Dobbin, £5 12s fid (costs £1 Is 6d); Same v. T. G. Carpentier, £5 4s fid (costs £1 10s 6d); Govett, Quiiliam and Hutchen v. T. W. Harding, £35 8s (costs £3 7s).

DAMAGE TO DWELLING..

Miss M. N. Pike claimed £l9 3s fid damages from Bruce Joll, who until recently was her tenant. After defendant gave up possession it was found that some windows needed replacing, plumbing work had to be done, and eleven totara piles had been removed from underneath the house. These repairs she had had done at her own expense, and she produced accounts showing she had paid for them. She sought to recover the cost of these repairs from defendant.

F. M. Grayling, contractor, gave evidence as to the removal of the totara piles. He thought the charges made for the other repairs reasonable. The Magistrate gave judgment in favor of plaintiff and. awarded £l5 3s fid damages (costs £3 19s). F.C.O.S. v. WINI RAWIRI.

The Magistrate gave his reserved decision in the case in which the Farmers’ Co-operative Society of New Zealand, Ltd., claimed £lOO from Wini Rawiri as damages sustained by plaintiff through a collision between a car owned by the plaintiff and driven by Mr. Clark, and a horse ridden by defendant. The collision took place on the hill on the Urenui side of the Waitara river bridge, about 7.30 p.m., on November 13 last. After tracing the case at length the Magistrate gavp judgment in favor of plaintiff. POSSESSION OF HOUSE. Henry Maddock (Mr. C. H. Croker) sought possession of a dwelling, of which he was the owner, from Richard T. Williams (Mr. R. C. Hughes). Defendant paid £1 a week rent and was now 12 weeks in arrears. Notice to quit had been served on defendant on April 11, but he was still in possession. Plaintiff, in evidence, stated that the tenancy was a weekly one, an arrangement which had been made verbally between the two parties. Mr. Hughes contended that defendant was entitled to a month’s notice. His motor lorry had been injured, and he had been hard hit in other ways. He had offered to pay £4 off his arrears, but this had not been accepted. After luncheon the Magistrate gave judgment for plaintiff, and defendant was given a fortnight in which to quit, the arrears in rent ( £l2) and costs to be paid. NATIVE LAND DEAL. Fitzherbert and Fitzherbert claimed from Wiki Pepe £57. Defendant was a native woman of Hastings Road, Hawera, and had given two promissory notes, one for £55, commission on a transaction of plaintiffs in effecting the I sale of certain native lands, and the other for £2 for cash lent. After hearing lengthy argument on both sides, the Magistrate gave judgment for £2, but non-suited on the claim on the other promissory note. CLAIM FOR MOTOR REPAIRS. F. H. Jellyman claimed from F. J. Darling £4l 18s 6d for repairs to a motor delivery van. Of this amount the defence admitted £l4 17s Cd, but disputed the claim for repairs to the crown wheel of the van. The case was adjourned in the hope that the parties concerned would come to an agreement.
