LIGHT-WEIGHT BREAD.
Auckland, May 7. Reserved decision was given by Mr. E. Cutten. S.M., in the case in which Walter Buchanan, baker, was charged with having sold bread the weight of which at the time was less than represented. The Magistrate said a curious feature about the case was that the seller represented a loaf to weigh 11b 14oz, and it in fact weighed 11b The prosecution contended that defendant mtifit be presumed to have represented a loaf to have weighed 21b. The Magistrate said that defendant represented a loaf to weigh 11b 140 z., which, if not a statement of its precise weight was a precise statement of its weight, and as the whole object of the Act was to prevent loaves being sold of a weight less than represented, surely it could not be a breach of its provisions to sell a loaf weighing- more than it was represented to weigh. It might or might not be that defendant, in selling loaves represented to weigh only lib 14oz at the price fixed by the Board of Trade for a 21b loaf, was not complying with the requirements of the Board of Trade. That, however, was not the question before the Court. The information was dismissed.
