COURT OF APPEAL.
A TARANAKI CASE,
By Telegraph—Press Association. Wellington, May 2. In the Court of Appeal this morning Mr. Justice Stringer delivered judgment in the case of T. F. G. Graham and another v. J. A. Bartlett, heard on April 13. The case arose out of a dispute concerning the purchase of a farm by appellants from respondent. The Judge in the Court below granted specific performance of the agreement for purchase. The Court of Appeal decided that appellants had established misrepresentation by respondent, and therefore allowed the appeal and granted the rescission of the agreement for purchase. Appellants were declared also to be entitled to the refund of the deposit with interest.
[On April 13 the Court of Appeal (Second Division) considered an appeal from the decision of Mr. Justice Salmond in granting Jessie Arnott Bartlett, of Hawera, widow, specific performance against Thomas Frank Graham, of Te I'.iri, farmer, and John Henry Graham, of Waitara, farmer, regarding the purchase of certain land. Judgment for the plaintiff 'had been given on October 6 last, and the appellants asked of the decision. The appellants contended that the judgment was erroneous both in law and in fact. After hearing the evidence the Court reserved its decision.]
