MANSON’S APPEAL. A TARANAKI DISQUALIFICATION. ALTERED TO SUSPENSION. Christchurch Last Night. Following is the judgment of Sir George Clifford, Mr. C. P. Skerrett, K.C., and Mr. Watkins, Racing Conference appeal judges, in the matter of the appeal by L. W. Manson, jockey, against the decision of the Taranaki District Committee dismissing his appeal against the decision of the committee of the Stratford Racing Club, in disqualifying Manson for six months for incompetent horsemanship in the Riding of Walton in the Lowgarth Welter Handicap on the second day of the Stratford meeting on January 3, 1921: The appellant (a licensed jockey) was on February 7, 1921, disqualified by the committee of the Stratford Racing Club for six months for incompetent horsemanship in the riding of Walton in the Lowgarth Welter Handicap on the second day of the Stratford Racing Club meeting on January 3, 1921. On February 15 the district committee of the Taranaki Jockey Club, on appeal, determined that the above decision should be approved, disqualification to date from the sth instant. The present appeal is from this decision. It is to be noticed that neither the judicial committee of the Stratford Racing Club nor the District Committee determined that appellant had committed any of the acts punishable by disqualification under rule I, part XXXII, nor any of the wilful acts punishable under rule 1, part XXV. The determination was that appellant offended by reason of “incompetent horsemanship”, and not by any wilful and intentional act on his part. We are of opinion that there was no power under the rules to inflict upon appellant, by reason only of “incompetent horsemanship”, the punishment of “disqualification” even for a limited period. Under rule 5, part IV, the circumstances might warrant the imposition for incompetent horsemanship in the race of the punishment of suspension from riding, but under the rules there is a great difference between the gravity and consequences of a punishment of “disqualification” and of “suspension”, even for a limited period. We therefore adjudge there wax no power under the rules to disqualify appellant. Under the rules we have power, and consequently the duty, on the hearing of the appeal, to determine what ought to be done under the circumstances brought before the tribunals before mentioned. Although upon their finding these tribunals had no, power to disqualify appellant, we are not prepared to say the evidence adduced before them would not justify them in suspending appellant. After a careful review of the evidence we have come to the conclusion that the justice of the case will be met by suspending appellant under rule 5, part IV. from riding for a period of three months from February 8, 1921, and we so determine. The deposit on appeal will be refunded to appellant.
