A PECULIAR CASE.
LOSS OF VESSEL AT SEA. By Telegraph.—PreßS Association. Auckland, Last Night. A somewhat unusual case came before Mr. Poynton, §,M., at fhe Magistrate's Court to-day. On March 27, 1910, the barquentine Lyman D. Foster sailed from Nukualofa for San Francisco with a cargo of copra, and has not been heard of since, and by consent of the owners (Messrs A. S. Patterson and Co., John Burns and Co., and 0. T. Nicol) the Minister of Marine entered an action to recover the sum of £175 3s, wages due to the crew. The object of the proceedings was to fix the date of the loss of the veßsel, this being done at the request of the owners. Captain Charles Fleming, Superintendent of Marine, said there was very little bad weather subsequent to the sailing of the vessel from Nukualofa. It was a fair assumption that the vessel was lost about March 31, 1919. Mr. Poynton accordingly food the date of the loss as March 31, and give judgment, for the sum claimed, less the sum paid into court.
