APPLICATION FOR DIVORCE. Unusual circumstances were disclosed in an undefended action for divorce which was before Mr. Justice Salmond at the Wellington Supreme Court. The petitioner was a young Englishwoman, and the respondent a German, wiio was deported with the Willochra draft. The petitioner said she was married on September 22, 1011, and came to New Zealand in the following year. There were three children of the marriage. In August, 1914, her husband was interned on Somes Island, but was liberated a month ' later. His employers, a freezing company, kept his position open for him, but the other workmen refused to work With hirn, and he then applied successfully, to be reinterned on the island, where he was employed as a conk. He was kept on the island this time for 15 months, a period during which she re- " ceived from him, through the Defence Department, £lB per month. Earlv in 19TG, he was again liberated, but within si few days he got under the influence of liquor and used language which resulted in his internment for the third time. On this occasion he worked at : road-making, receiving 3s a day, but h Mvei ajrain sent bar ens money far
maintenance. Just before he was deported, he told her he. would take her to Germany, but she refused the offer, Petitioner asked for a decree on the ground of desertion, but His Honour 6aid there was no evidence of desertion. The respondent maintained his wife until his final internment in 1910, and also offered to take her to Germany. Counsel submitted that the fact that respondent failed to maintain his wife since lflHi constituted desertion, and brought him within the four corners of the Act of 1914. His Honour: Then you might as well argue that a man who is in gaol for over four years is guilty of desertion. His Honour ruled that there was no evidence of desertion, but said he would give counsel an opportunity to argue the point, and to that end he adjourned the hearing.
