MAGISTRATE'S COURT. (From Our Own Correspondent.)' Eltham, Oct. 6. Mr. T. A. B. Bailey, S.M., presided at the fortnightly sitting- of tlie Magistrate's Court to-day. .'Thomas Thompson (Mr. T. B. Crump) sued George Baldwin for possession of three rooms of a house jointly occupied by plaintiff and defendant. The plaintiff stated that the house was mortgaged to the State Advances Department, and there were arrears of payments amounting to £IOO. He had received an offer of twelve months' tenancy at 22s fid a week for the house, and unless he could obtain possession for the purpose of soiling the premises •or letting under the advantageous offer, he would lose the place altogether. Defendant stated that be was 74 years of age, and lived alone. He was quite willing to vacate the rooms if he could get another place, but lie was quite unable to do go. The Magistrate made- an order giving possession in 21 days. The defendant would be required to find other accommodation within 14 days, as unless the plaintiff obtained possession he would be in danger of losing his property. The adjourned case of Edward Antony Laurent v. Joseph Kerr,, claiming £2OO damages in connection with a bull alleged to have been wrongfully retained by the defendant, was resumed. After taking tin* evidence of J. L. Rogers, stock agent, the case was further adjourned until next court day, when argument relative to a non-suit point raised by the defendant will be heard.
